This course demonstrates the importance to legislative drafting of ‘upstream’ processes such as legislative planning, policymaking and the emergence of regulatory reform and regulatory management policies to improve the quality of policymaking and legislation. Equally, it demonstrates the importance of ‘downstream’ activities such as law reform, statute law revision, and consolidation of legislation.

Module 1: An Overview of Legislative Drafting

  • An overview of the context for legislative drafting

  • An overview of the three broad approaches to legislative drafting globally

Module 2: The Process of Legislative Drafting

  • A detailed look at the process of legislative drafting

Module 3: An overview of the policies developed over the last 30 years

  • An overview of the policies developed over the last 30 years to improve the quality of legislation.

  • These include work by the OECD, the World Bank, and other international organisations to develop Better Regulation policies.
